I DL'd a patch from the Activision website. It's on my desktop as a exe file (blue and white window). I decided not to run it but I can't delete it now. It says it's being used by another program, but there's nothing open when I try to delete. I even restarted and tried then but no luck.
Anyone know how to get rid of it?

There are several solutions at the *** CNET forum***.

If booting to Safe Mode to delete it doesn't work, that "Move on Boot" program they mention might be the easiest way.

Just did a System Restore and it disappeared.
Never had that problem before.

I've had it, though not often. I managed to delete the offending file using the command line, but I don't remember all the steps. The same file redownloaded did not cause the same problem, so I'm not sure what causes it. I'd say it was "Windows being Windows" except I've had the same problem on a Mac.
